At SBMB, we are often asked whether or not medication errors are considered medical malpractice and the answer we give is, it depends on the case. Is the medication error a small one with minor consequences that don’t have any long-term lingering effects? The reason that’s important is, even if it was a mistake, if it didn’t have any serious consequences then it’s not a mistake that’s worth pursuing in a court of law. On the other hand, our lawyers have been involved in cases where medication errors can lead to catastrophic problems, sometimes lifelong problems. A medication error, whether by a nurse, a pharmacy who dispenses it or a doctor who orders it, is a real potential medical malpractice entitling the victim of that to potential compensation.
