Separation Agreements
Most of our clients are able to resolve matters without resorting to the courts. With each spouse represented by counsel (normally) and with proper financial disclosure, we will represent your interests to ensure a fair and equitable settlement which is formalized in a written contract known as a Separation Agreement. The Separation Agreement details the applicable terms which will govern your relationship with your children and your former spouse going forward. Though it is easy to obtain precedent Separation Agreements on the internet or at bookstores, a Separation Agreement is a very important document which you should not sign in the absence of independent legal advice. Only a qualified and experienced lawyer can properly advise you in this complex area of law.
Marriage Contracts and Cohabitation Agreements
Prior to or during cohabitation or marriage, spouses can enter into a domestic contract which governs their affairs while they cohabit and pre-determines spousal support and property issues in the event of a separation. The law allows couples to contract out of what might otherwise be rights and obligations imposed by statute. Again, this is a complex and subtle area of law. In addition to proper financial disclosure, each party should obtain the benefit of independent legal advice. We can properly advise and represent your interests. Call us. We can help.
